A settlement (“Settlement”) has been proposed in the class action lawsuit referenced above pending in the United States District Court for the Southern District of New York, Case No. 1:16-cv-00354-PGG (“Action”).
- The lawsuit alleges that Fishs Eddy willfully violated a federal law (known as the Fair and Accurate Credit Transactions Act or FACTA, 15 U.S.C. §1681c(g)) by printing on certain customer receipts more than the last 5 digits of its customer’s credit card or debit card. Fishs Eddy disputes the class action allegations and denies that it willfully violated FACTA. The Court has not yet decided in favor of either party. Instead, both sides have agreed upon a proposed Settlement of the lawsuit to avoid the uncertainty and cost of a trial, and to provide benefits to Class members. Fishs Eddy does not admit any violation of FACTA by agreeing to the proposed Settlement.
- Fishs Eddy will establish a non-reversionary cash fund in the amount of $280,000 (the “Cash Fund”). If you are a Class member, you may be entitled to an amount up to $250.00. To obtain payment, you must complete and submit a valid claim form by the deadline of September 19, 2018.
